PUBLIC OFFER OF NEXT TO YOU…

1. General Provisions

1.1. This document is a public offer of Individual Entrepreneur KAZITLEARN (IE KAZITLEARN) (hereinafter referred to as the “Contractor”, the “Operator”) and contains the terms for providing access services to the Next to you… web service at https://nexttoyou.space.

1.2. The Offer is addressed to individuals aged 21 and older who wish to use the Service to find people nearby, communicate, send “knocks”, open chats, arrange safe meetings, select plans, and use other Service functions.

1.3. Acceptance of the Offer means registration in the Service, e-mail confirmation, use of the Service functions, selection of a paid plan, submission of a payment request, actual payment, or any other action clearly indicating acceptance of the terms of this Offer.

1.4. From the moment of acceptance, a service agreement between the Contractor and the User is deemed concluded on the terms of this Offer.

1.5. Before accepting the Offer, the User must carefully read the Offer, the Privacy Policy, and the Terms of Use of the Service.

2. Terms

2.1. “Service” means the Next to you… web application available at https://nexttoyou.space.

2.2. “User” means an individual aged 21 or older who is registered in or uses the Service.

2.3. “Plan” means a set of functional capabilities of the Service: Free, Plus, or Pro.

2.4. “Knock” means a request from one user to another user to open the possibility of communication.

2.5. “Chat” means internal correspondence between users within the Service.

2.6. “Meeting” means a mode of interaction between two users after mutual consent to communicate.

2.7. “Plan request” means a user’s request to activate a paid plan after payment or intention to pay.

3. Subject of the Agreement

3.1. The Contractor provides the User with access to the Service functions within the scope provided by the selected plan and the technical capabilities of the Service.

3.2. The Service provides a technical platform for discovering people nearby, sending “knocks”, opening an internal chat, managing visibility, verification, support, and other functions.

3.3. The Contractor is not a marriage agency, psychological service, dating service with a guaranteed result, organizer of personal meetings, or a party to personal relationships between users.

3.4. The Contractor does not guarantee that the User will find a partner, friend, conversation partner, meeting, consent of another user, a specific number of people nearby, a specific result of communication, or safety of users’ actions outside the Service.

3.5. The User independently makes decisions about meetings, communication, transfer of data, and interaction with other users.

4. Registration and Access Conditions

4.1. Registration is allowed only for persons who have reached the age of 21.

4.2. The User must provide accurate data and must not create accounts on behalf of other persons.

4.3. The Contractor may refuse registration, block an account, or restrict access if there is suspicion of age violation, creation of a fake account, fraud, safety threat, or violation of the Terms of Use.

4.4. Access to certain functions may require e-mail confirmation, enabling geolocation, completing a profile, passing verification, or activating a plan.

5. Plans and Functional Limitations

5.1. The Free plan is provided free of charge and includes: Outgoing knocks: 3 per day; Incoming knocks and accepting incoming knocks: unlimited; Only one active chat or meeting is available at a time; radius up to 250 m.

5.2. The Plus plan is provided for 2.19 USD for 30 days and includes: Outgoing knocks: 10 per day; Incoming knocks and accepting incoming knocks: unlimited; Only one active chat or meeting is available at a time; radius up to 1 km.

5.3. The Pro plan is provided for 4.29 USD for 30 days and includes: Outgoing knocks: 25 per day; Incoming knocks and accepting incoming knocks: unlimited; Only one active chat or meeting is available at a time; radius up to 3 km.

5.4. Distances are displayed in a soft format: 0–50 m — “Nearby”, 50–150 m — “Very close”, 150–250 m — “Close”, 250–500 m — “Within radius”, 500–1000 m — “Far”, 1000–3000 m — “Very far”. Users are not shown to each other beyond 3000 m.

5.5. The Contractor may change plans, limits, and functionality by publishing a new version of the Offer or notifying users through the Service interface. Changes do not worsen an already paid period unless otherwise required by law or Service safety.

6. Payment and Plan Activation

6.1. Payment for paid plans is made through the available online payment methods shown in the Service interface, including PayPal and other connected payment methods.

6.2. When paying through PayPal, the plan is activated automatically after successful payment confirmation by the payment provider. An administrator may change a plan manually only for support, correction, or individual service cases.

6.3. The User must use the correct account and, when contacting support, provide the account e-mail, plan, payment date, amount, and payment identifier if available.

6.4. The plan is activated for 30 calendar days from successful payment confirmation unless otherwise specified in the interface or an individual arrangement.

6.5. If the User has paid for a plan but the plan has not been activated automatically within a reasonable time, the User must contact support at info@nexttoyou.space or through the support section.

7. Refunds and Refusal of Service

7.1. The User may submit a refund request if payment was made by mistake, the plan was not activated, the service was not provided due to the Contractor’s fault, or there are other grounds provided by the legislation of the Republic of Kazakhstan.

7.2. If the paid plan was activated and the User actually received access to extended functions, a refund may be refused, except in cases provided by law or by a separate decision of the Contractor.

7.3. A refund request must be sent to info@nexttoyou.space and must include the account e-mail, plan, payment date, amount, payment method, and reason for the refund.

7.4. The Contractor reviews requests within a reasonable time and may request additional information to verify the payment and circumstances.

8. Rights and Obligations of the Contractor

8.1. The Contractor undertakes to provide access to the Service within the selected plan and technical availability.

8.2. The Contractor may temporarily restrict access to the Service for maintenance, updates, error correction, security, or force majeure.

8.3. The Contractor may moderate accounts, chats, complaints, verifications, plan requests, and support requests.

8.4. The Contractor may block or delete accounts, restrict functions, reject verification, hide profiles, and refuse service in case of violation of the Offer, Terms, or law.

8.5. The Contractor may update the interface, functionality, limits, and technical requirements of the Service.

9. Rights and Obligations of the User

9.1. The User undertakes to comply with the legislation of the Republic of Kazakhstan, this Offer, the Privacy Policy, and the Terms of Use.

9.2. The User undertakes not to mislead other users, not to use another person’s data, not to create fake accounts, not to stalk, threaten, insult, or violate the safety of other users.

9.3. The User undertakes not to transfer account access, password, or confirmation codes to third parties and not to use the Service for spam, fraud, advertising, illegal data collection, or other prohibited purposes.

9.4. The User independently assesses the risks of personal meetings and must observe safety measures.

10. Liability and Limitations

10.1. The Contractor is not responsible for the actions, inaction, words, intentions, accuracy of data, meetings, and behavior of other users beyond reasonable moderation of the Service.

10.2. The Contractor does not guarantee uninterrupted and error-free operation of the Service but takes reasonable measures to restore operability.

10.3. The Contractor is not responsible for losses arising from the User’s violation of safety rules, voluntary transfer of personal data to third parties, meeting with an unfamiliar person, technical communication failures, account blocking for violation of rules, or actions of third parties.

10.4. The Contractor’s liability is limited to the amount actually paid by the User for the relevant plan period, unless otherwise expressly provided by the legislation of the Republic of Kazakhstan.

11. Personal Data

11.1. Personal data processing is carried out in accordance with the Privacy Policy posted on the Service website.

11.2. Acceptance of this Offer means the User’s consent to the processing of personal data for the purposes of registration, operation of the Service, geolocation, security, billing, support, and performance of the agreement.

12. Intellectual Property

12.1. All rights to the Service, design, software code, database, interfaces, texts, logic, trademarks/signs, and materials belong to the Contractor or are used by the Contractor on a lawful basis.

12.2. The User may not copy, distribute, modify, decompile, sell, rent, use the code, interface, or materials of the Service without the Contractor’s written consent.

12.3. Content posted by the User remains with the User, but the User grants the Contractor the right to use such content to the extent necessary for the operation of the Service, moderation, support, and protection of rights.

13. Dispute Resolution

13.1. The parties shall seek to resolve all disputes under this Offer through negotiations and by sending a written claim to info@nexttoyou.space.

13.2. The claim review period is up to 15 business days unless another period is established by law or additional verification is required.

13.3. If no agreement is reached, the dispute shall be considered in accordance with the legislation of the Republic of Kazakhstan at the location of the Contractor, unless otherwise provided by mandatory rules of law.

14. Term and Amendment of the Offer

14.1. The Offer is valid from the moment of publication on the website until it is withdrawn or replaced by a new version.

14.2. The Contractor may amend the Offer. The new version enters into force from the moment of publication on the website unless another effective date is specified in the new version.

14.3. Continued use of the Service after publication of changes means the User’s consent to the new version.
